HoroscoPet Terms of Use

These terms govern the use of the HoroscoPet app ("the App"), developed and published by Gabriele Murari ("we"). By using the App you accept these terms. If you do not accept them, do not use the App.

1. What the App is

HoroscoPet creates daily horoscopes, birth charts and daily indicators for dogs and cats, based on the data you enter. The content is generated automatically by algorithms and, in part, by artificial intelligence systems.

2. Entertainment only

All content in the App (horoscopes, birth chart, indicators such as appetite, happiness, sociability and energy, and any other text) is provided solely for entertainment and leisure purposes.

• Astrology has no scientific basis. The content does not describe your animal's real character, state of health or behaviour, and does not allow them to be predicted.
• The content is not advice of any kind: it is not veterinary, medical, behavioural, dietary, training, legal, financial or any other advice, and it does not replace the opinion of a veterinarian or a qualified professional.
• Automatically generated text may contain errors, inaccuracies or inappropriate statements.

3. You are not required to follow the content

You are in no way required to follow, apply or take into account anything written in the App. Any decision you make, even after reading content in the App, is made freely by you and under your sole responsibility.

For any matter concerning your animal's health, diet, care, behaviour or well-being, always consult a veterinarian. In an emergency, contact a veterinarian immediately.

4. Animals and owner responsibility

The App does not deal with the care of animals and has no control over them. The owner or whoever has custody of the animal remains solely responsible for its health, well-being, safety and behaviour, including towards other people, animals or property (for Italy, art. 2052 of the Italian Civil Code).

To the extent permitted by law, we are not liable for:

• the health, well-being or behaviour of any animal;
• damage suffered by animals;
• damage caused by animals to people, to other animals or to property;
• consequences of decisions made on the basis of the App's content.

5. Permitted use

You may use the App for personal and non-commercial use. You may not:

• use it for unlawful purposes or to harm others;
• attempt to access the systems that make it work, circumvent its protections or use it in an automated way;
• copy, modify or distribute the App or its content beyond what is allowed by the sharing features.

When you share a horoscope, you are responsible for what you share and with whom. Shared content remains subject to these terms, including the fact that it is entertainment only.

6. The App is provided "as is"

The App and its content are provided "as is" and "as available". To the extent permitted by law, we do not guarantee that:

• they are accurate, complete, up to date or fit for a particular purpose;
• the App is always available, error-free or compatible with every device.

We may modify, suspend or discontinue the App or some of its features at any time.

7. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any damage, direct or indirect, arising from the use of or inability to use the App or its content. This exclusion covers, for example:

• loss of data;
• damage to animals, people or property;
• veterinary expenses;
• consequences of decisions made on the basis of the content.

Liability that the law does not allow to be excluded. Nothing in these terms excludes or limits our liability where the law does not allow it: for wilful misconduct or gross negligence (art. 1229 of the Italian Civil Code), for personal injury, and for the rights to which consumers are entitled and which cannot be excluded by law, including those provided for by the Italian Consumer Code and by European Union rules.

8. Advertising and third-party content

The App may show advertisements provided by third parties and contain links to third-party services, including app stores. We are not responsible for products, services or content advertised or offered by third parties, nor for their privacy rules.

9. Intellectual property

The App, its name, graphics, illustrations and texts are owned by us or used under licence. The photos you add remain yours and stay on your phone.

10. Privacy

Data processing is described in the Privacy Policy, available in the App and at https://horoscopet.web.app/en/privacy.

11. Changes to the terms

We may update these terms. The date at the top indicates the latest version. If the changes are significant, we will let you know in the App. By continuing to use it after the change, you accept the new terms.

12. Governing law and jurisdiction

These terms are governed by Italian law. If you are a consumer, the mandatory rules of the country where you reside and the jurisdiction of the court of the place where you reside or are domiciled remain unaffected.
